These General Terms and Conditions of Sale ("Terms") govern all purchases made through the website francescacottone.it ("Website"), operated by G.M.NEW LINE SARTORIA SRL, with registered office at Via Nannino Crescentini, 8 — 62024 Matelica (MC), Italy — VAT number IT01629930437 ("Seller").

By placing an order on the Website, you ("Customer") accept these Terms in full. Please read them carefully before completing your purchase.

2. Products

All products available on the Website are described and illustrated as accurately as possible. However, product images are for illustrative purposes and may differ slightly from the actual item due to screen settings, photography lighting, or the natural characteristics of the materials used. Minor variations in color, texture, or finish are not considered defects.

Product availability is subject to change without notice. In the event that a product becomes unavailable after an order has been placed, we will notify you promptly and issue a full refund.

3. Prices and taxes

All prices displayed on the Website are in Euros (€) and include VAT where applicable for EU customers. For customers located outside the European Union, prices are displayed exclusive of any local customs duties, import taxes, or additional charges, which remain the sole responsibility of the Customer.

We reserve the right to modify prices at any time without prior notice. However, any price changes will not affect orders that have already been confirmed.

4. Orders

By placing an order, the Customer makes a binding offer to purchase the selected products. An order confirmation email will be sent to the email address provided. The contract of sale is concluded when the order is confirmed by the Seller.

We reserve the right to refuse or cancel any order for legitimate reasons, including but not limited to: stock unavailability, suspected fraud, errors in product information or pricing. In such cases, the Customer will be notified and any payment already made will be refunded in full.

5. Payment

We accept the following payment methods: credit and debit cards (Visa, Mastercard, American Express) processed via Stripe, PayPal, and Klarna. All transactions are processed securely through encrypted, PCI-compliant payment gateways. Full details are available on our Payments page.

6. Shipping and delivery

We ship to selected countries worldwide. Shipping costs and estimated delivery times vary depending on the destination and the shipping method selected. Full details are available on our Shipping page.

Risk of loss and title for purchased items pass to the Customer upon delivery to the carrier. We are not responsible for delays caused by the courier, customs processing, or force majeure events.

7. Right of withdrawal

In accordance with EU Directive 2011/83/EU, Customers have the right to withdraw from the purchase within 14 calendar days from the date of receipt of the goods, without providing any reason. Full details, including the return procedure, are available on our Returns & Withdrawal page.

8. Warranty and liability

All products sold through the Website are covered by the legal warranty of conformity as provided by Articles 128–135 of the Italian Consumer Code (Legislative Decree 206/2005). This warranty covers defects of conformity that become apparent within 24 months from the date of delivery.

The warranty does not cover damage caused by misuse, negligence, improper care, normal wear and tear, unauthorized alterations, or failure to follow care instructions provided with the product.

9. Intellectual property

All content on the Website — including but not limited to text, images, graphics, logos, designs, and product descriptions — is the exclusive property of G.M.NEW LINE SARTORIA SRL or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. No content may be reproduced, distributed, or used without prior written consent.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Website or the purchase of products. Our total liability shall not exceed the amount paid by the Customer for the specific order giving rise to the claim.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Italian Republic. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Court of Macerata (MC), Italy, unless otherwise required by mandatory consumer protection laws applicable in the Customer's country of residence.

12. Modifications

We reserve the right to update or modify these Terms at any time. Any changes will be published on this page with an updated "Last updated" date. Continued use of the Website after such modifications constitutes acceptance of the revised Terms.
